Charter Terms — Version September 2026
YachtSailing.com and YachtSailing.gr are websites through which the yachts presented here are marketed and charter enquiries, bookings and related charter arrangements are coordinated.
Each yacht is owned and chartered by the yacht-owning company identified in the applicable charter documentation.
YachtSailing.com and YachtSailing.gr are operated by Unique Sailing NEPA, 18 Kalamakiou Street, 17455 Alimos, Greece.
Submitting an enquiry, availability request or pre-booking through YachtSailing.com or YachtSailing.gr does not by itself constitute a confirmed charter.
Once a yacht, charter period, price and applicable terms have been agreed, the relevant charter documentation is issued identifying the Yacht, the Charterer and the yacht-owning company.
The Charterer is responsible for reviewing the charter particulars and informing us promptly of any discrepancy.
The applicable Charter Order, together with its Charter Conditions, any Special Conditions or Addenda, and these Charter Terms, forms the basis on which the booking is made.
The official Charter Party required for the charter is issued and registered in accordance with applicable requirements.
Unless otherwise specifically agreed in the applicable charter documentation, 40% of the Charter Fee is payable upon booking and the remaining 60% is payable 45 days before embarkation.
For bookings made more than one year in advance, different payment stages may apply as specified in the applicable charter documentation.
All charter payments are made in EUR to the yacht-owning company or to the recipient expressly identified in the applicable charter documentation.
Additional operating expenses, crew costs and optional services applicable to the charter are stated separately from the Charter Fee where applicable.
Any cancellation must be communicated in writing.
Payments made are non-refundable unless the Yacht is successfully re-chartered for the same Charter Period.
In the event of cancellation, reasonable efforts will be made to re-charter the Yacht. If successful, the amount recovered from the replacement charter will be refunded to the Charterer after deduction of any reasonable costs, commissions or reduction in charter price required to secure the replacement booking, up to the amount originally paid by the Charterer.
Re-chartering cannot be guaranteed.
Trip cancellation and travel insurance are strongly recommended.
The Owner is responsible for delivering the Yacht at the agreed Port of Delivery in full commission and working order, seaworthy, clean, properly equipped and ready for the agreed charter.
If the Yacht cannot be delivered at the agreed time, the provisions concerning delayed delivery contained in the applicable charter documentation will apply.
Where appropriate, the Owner may propose a replacement yacht of a similar or superior standard. Any such arrangement will be communicated to the Charterer.
The crew required for each Yacht is arranged in accordance with the applicable charter documentation and Greek law.
Captains and other professional crew members engaged for the yachts presented through YachtSailing are appropriately qualified to perform their respective professional duties in accordance with applicable requirements.
YachtSailing works with established maritime professionals and crew with relevant charter experience and industry background. Crew arrangements may vary between yachts and charters depending on the Yacht, availability, operational requirements and the services included in the applicable booking.
The Captain has final authority concerning the safe navigation, operation and movement of the Yacht.
Guest preferences regarding destinations, anchorages and the general character of the trip are an important part of planning the charter. However, navigation and operational decisions remain subject to the Captain's professional judgment, taking into account weather, sea conditions, safety, port conditions, applicable regulations, the Yacht's capabilities and the requirement to return the Yacht to the agreed Port of Re-delivery on time.
The Charterer and all guests must comply with reasonable safety and operational instructions given by the Captain and crew.
A yacht charter is an active outdoor holiday taking place in a marine environment. By its nature, it involves exposure to the sea, changing weather and sea conditions, movement of the Yacht, swimming and access to and from the water, tenders, docks, beaches and other vessels.
Normal activities onboard and around the Yacht — including moving around the deck, boarding and disembarking, swimming, snorkeling and using recreational equipment — involve inherent risks that cannot be completely eliminated.
Each guest is expected to exercise reasonable care and common sense, remain aware of their surroundings and personal abilities, and follow the safety and operational instructions of the Captain and crew.
Participation in swimming, watersports and other recreational activities is voluntary and should be appropriate to the guest's age, physical ability, swimming ability, experience and the prevailing conditions.
The Captain may restrict or prohibit any activity whenever considered appropriate for safety, weather, regulatory or operational reasons.
Children are welcome onboard, but parents and guardians should understand that a yacht charter is an active outdoor holiday in a marine environment and requires an appropriate level of supervision.
Parents or guardians remain responsible for the safety, supervision, conduct and activities of their children at all times.
The Captain and crew will provide safety instructions and may intervene, restrict an activity or require the use of appropriate safety equipment where necessary, but they do not provide childcare and do not assume responsibility for the continuous supervision of children.
The appropriate level of supervision depends on the child's age, swimming ability, experience, behaviour and the circumstances at the time. Particular attention should be given when children are on deck, moving around the Yacht, boarding or disembarking, close to the water, swimming or using recreational equipment.
Parents and guardians are responsible for deciding whether their child should participate in a particular activity, subject always to the Captain's overriding authority to restrict or prohibit an activity for safety reasons.
Children must comply with all safety instructions and use life jackets or other safety equipment whenever required by the Captain or crew.
Guest preferences and priorities are taken into consideration when planning the trip. However, no specific itinerary, island, anchorage, route or number of destinations is guaranteed unless expressly agreed otherwise in writing.
Yacht itineraries remain flexible throughout the charter.
Weather and sea conditions, port availability, safety considerations, technical or operational circumstances and decisions of the competent authorities may require the Captain to modify the route, destination, anchorage, departure time or time spent underway.
Such changes, when reasonably made for safety, weather, regulatory or operational reasons, do not by themselves constitute cancellation or non-performance of the charter.
Remaining flexible with the itinerary is an important part of allowing the Captain and crew to make the most of the conditions and provide a successful overall experience.
Swimming, snorkeling, paddleboarding, sea scooters and other recreational activities are optional activities involving inherent risks associated with the sea, weather and water conditions, physical ability and the use of equipment.
Guests participate according to their own ability and are responsible for exercising reasonable care, following all instructions provided by the Captain and crew and using any required safety equipment.
Recreational equipment may only be used with the Captain's permission and under the conditions specified by the Captain or crew.
The Captain may restrict or prohibit its use at any time based on weather, sea conditions, location, marine traffic, the guest's age, ability or behaviour, applicable regulations or any other safety consideration.
Guests must not use recreational equipment while impaired by alcohol, drugs or any condition that may affect their ability to use it safely.
Children may use recreational equipment only with appropriate parental or guardian supervision and subject to the Captain's permission.
Guests may be required to receive additional safety instructions or acknowledge specific safety requirements before using certain recreational equipment.
At the beginning of the charter, guests will receive an onboard safety briefing covering the principal safety procedures and equipment of the Yacht.
Guests are expected to pay attention to the briefing, familiarise themselves with the relevant safety equipment and follow instructions given by the Captain and crew throughout the charter.
Conditions onboard a yacht differ from those in a hotel or other land-based accommodation. Decks, steps, gangways, hatches, tenders and access to and from the Yacht require reasonable attention and care, particularly when wet or when the Yacht is moving.
Guests should inform the Captain of any circumstance relevant to their safe participation in an activity where appropriate.
The Charterer is responsible for operating expenses and additional costs identified in the applicable charter documentation.
Depending on the Yacht and agreed charter arrangement, these may include fuel, port and marina fees, provisioning, food and beverages for the Charterer's party, crew meals, communications, end cleaning and specifically requested optional services or equipment.
Where an Advance Provisioning Allowance (APA) or other advance payment for operating expenses has been agreed, expenditure will be accounted for and any remaining balance or additional amount due will be settled in accordance with the applicable charter documentation.
The Yacht is provided exclusively for recreational use by the Charterer and the guests identified for the charter.
The maximum permitted number of persons onboard must not be exceeded.
The Charterer and guests must comply with applicable laws and regulations and must not engage in conduct that endangers the Yacht, crew, other guests or third parties.
Illegal drugs and unlawful weapons are strictly prohibited onboard.
The Owner or Captain may terminate or restrict the charter where serious or continuing unlawful, dangerous or abusive conduct makes continuation unsafe or unlawful.
Guests are responsible for exercising appropriate judgment regarding alcohol consumption, particularly before swimming, using recreational equipment, boarding or disembarking the Yacht or participating in activities around the water.
The Captain may restrict swimming, watersports or the use of recreational equipment where, in the Captain's judgment, alcohol consumption or any other impairment creates an increased safety risk.
The Charterer is responsible for loss or damage caused by the Charterer or members of the Charterer's party in accordance with the applicable charter documentation and applicable law.
Where damage is covered by the Yacht's insurance, the Charterer's liability may extend to the applicable insurance excess or deductible.
The Charterer may be liable for a greater amount where an act or omission of the Charterer or a guest causes or contributes to the loss of insurance coverage.
Guests are also responsible for the reasonable care and proper return of recreational equipment provided for their use.
Each Yacht carries the insurance required for its professional charter operation under applicable Greek law.
The Yacht's insurance does not replace personal travel, medical, accident, cancellation, curtailment or personal-effects insurance for the Charterer and guests.
Guests are strongly advised to obtain appropriate travel and cancellation insurance for their individual circumstances.
A yacht contains mechanical, electrical, electronic and marine systems operating continuously in a demanding environment. Technical issues may occasionally arise during a charter.
The Owner and crew will use reasonable efforts to investigate and resolve technical problems as quickly as reasonably practicable.
The occurrence of a technical problem does not by itself constitute cancellation of the charter or automatically create an entitlement to a refund.
Any rights or remedies will depend on the nature and duration of the issue, its material effect on the use of the Yacht, the steps reasonably taken to remedy it, the applicable charter documentation and applicable law.
If the Owner is unable to deliver the Yacht at the agreed commencement of the Charter Period, reasonable efforts will be made to resolve the delay or, where appropriate, offer a suitable alternative.
The Charterer's rights in the event of delayed delivery or failure to deliver are governed by the applicable charter documentation.
Where the charter cannot proceed and no agreed replacement or alternative arrangement is provided, any refund due will be handled by the yacht-owning company in accordance with the applicable charter documentation and law.
If the Charterer or any member of the Charterer's party chooses to leave the Yacht or terminate participation in the charter before the agreed end of the Charter Period for reasons not attributable to the Owner, this does not by itself create an entitlement to a refund for the unused portion of the charter.
The Yacht must return to the agreed Port of Re-delivery within the agreed Charter Period.
The Captain will plan and adjust the itinerary throughout the charter as necessary to allow sufficient time for the Yacht's safe and timely return.
The Charterer must not request or insist upon an itinerary that, in the Captain's reasonable judgment, could prevent timely re-delivery.
Unless otherwise expressly agreed in the applicable charter documentation, the Yacht may return to its base on the evening preceding final disembarkation, with guests remaining onboard until the agreed disembarkation time.
Any problem or complaint arising during the charter should be brought to the Captain's attention as soon as reasonably possible so that an opportunity is provided to investigate and resolve the matter while the charter is in progress.
If the matter cannot be resolved onboard, the Charterer should contact the Owner or YachtSailing promptly so that assistance can be provided.
Where reasonably possible, complaints should be confirmed in writing and include sufficient information to allow the matter to be properly assessed.
Failure to report an issue during the charter may affect the ability to investigate or remedy it at the time.
Guests remain responsible for their personal belongings and are encouraged to maintain appropriate insurance for personal property brought onboard or taken ashore.
The Owner's responsibility for loss of or damage to personal property is subject to the applicable charter documentation and applicable law.
The yacht-owning company identified in the applicable charter documentation is the contractual provider of the Yacht.
The specific Charter Particulars, Charter Conditions, Special Conditions and Addenda agreed for an individual booking take precedence over general information appearing on YachtSailing.com or YachtSailing.gr in the event of an inconsistency.
Information, photographs, specifications, sample itineraries, indicative operating costs and other content appearing on the websites are provided to assist guests in selecting and planning their charter.
Yacht specifications, equipment and services may change from time to time as a result of maintenance, refit, replacement, regulatory requirements or operational circumstances.
The particulars confirmed for an individual charter are those contained in the applicable charter documentation.
The charter relationship is governed by the applicable charter documentation and Greek law.
Nothing contained in these Charter Terms is intended to exclude or restrict any right or liability that cannot lawfully be excluded or restricted.
